1. Siamo preoccupati che:

Il Ufficio Brevetti Europeo (UBE) ha, in contraddizione con le parole e lo spirito della legge scritta, garantito decine di migliaia di brevetti su regole informatiche di elaborazione dati con equipaggiamenti standard, di seguito chiamate "brevetti software".
La Commissione Europea ha proposto di legalizzare questi brevetti e renderli uniformemente efficaci in Europa. Nel fare ci?a disatteso la manifesta e ben argomentata dissertazione della vasta maggioranza dei professionisti del software, compagnie di software, esperti d'informatica ed economi.
I proponenti hanno tentato di distrarre e (%ip:intimidire) il Parlamento Europeo. Essi hanno presentato la proposta come un mezzo per escludere la logica di business e il software dalla brevettabilitࠥ hanno minacciato che il Parlamento Europeo avrebbe perso la possibilitࠤi partecipare qualora avesse votato per una vera limitazione della brevettabilitஊ
Dal momento che il Parlamento Europeo ha rifiutato di essere distratto o intimidito, influenti professionisti dei brevetti in vari governi e organizzazioni stanno adesso tentando di usare il Consiglio dei Ministri Europeo per aggirare la democrazia parlamentare nell'Unione Europea.

2. Per queste ragioni noi chiediamo:

Chiediamo che l'Ufficio Brevetti Europeo e gli uffici brevetti nazionali smettano immediatamente di garantire brevetti su logiche di business e metodi di elaborazione dati in qualsiasi forma di camuffamento verbale e applichino l'(%ar:Articolo 52 della Convenzione Europea sui Brevetti) correttamente, in accordo con i (%ee: metodi convenzionali di interpretazione della legge).
Chiediamo che i membri del Consiglio Europeo dei Ministri rinuncino ad ogni controproposta sulla versione del documento del Parlamento Europeo, a meno che queste controproposte non vengano esplicitamente suffragate da una decisione a maggioranza dai membri del parlamento nazionale.
Chiediamo ai membri dei parlamenti nazionali di formulare chiari regolamenti nazionali sulla brevettabilitࠥ di accertarsi che i rappresentanti del loro governo al al Consiglio Europeo stiano fedelmente implementando tali regolamenti.
Noi chiediamo che tutte le proposte legislative, inclusa quella del Parlamento Europeo e gli stati membri, siano rigorosamente verificate con un (%ts: campione) di semplici richieste di brevetto per vedere se esse oltre ogni dubbio portino ai risultati desiderati e non lascino spazio a differenti interpretazioni.

European Software Patents: Assorted Examples: We came across the following impressive examples at first reading through our tabular listings of software patents. They were almost randomly chosen and thus approximately represent the technicity and inventivity standards of the European Patent Office. If anything distinguishes them from other patents it is the relative ease with which they can be understood at first sight by a fairly large public.

Patentability Legislation Benchmarking Test Suite: In order to test a law proposal, we try it out on a set of sample innovations. Each innovation is described in terms of prior art, a technical contribution (invention) and a small set of claims. Assuming that the descriptions are correct, we then test our proposed legislation on them. The focus is on clarity and adequacy: does the proposed rule lead to a predictable verdict? Which of the claims, if any, will be accepted? Is this result what we want? We try out different law proposals for the same test series and see which scores best. Reazzione a la Decisione del Parlamento UE de 03-09-24: Frits Bolkestein, Malcolm Harbour and other politicians have joined in a choir of patent lawyers who are saying that "the European Parliament ruined its chances of democratic participation" by failing to vote as the patent establishment had asked it to vote. Preparations are under way to withdraw the directive and legalise software patents by means of an agreement between national patent officials, who are used to deciding patent policies among themselves.
EU Council 2004 Proposal on Software Patents: The Council of Ministers has reached political agreement on a paper which contains alternative suggestions to the amendments on the directive "on the patentability of computer-implemented inventions" passed by the European Parliament (EP). In contrast to the EP version, the council version permits unlimited patentability and patent enforceability. Following the current version, "computer-implemented" algorithms and business methods would be inventions in the sense of patent law, and the publication of a functional description of a patented idea would constitute a patent infringement. Protocols and data formats could be patented and would then not be freely usable even for interoperability purposes. These implications might not be apparent to the casual reader. Here we try to decipher the misleading language of the proposal and explain its implications.
Proposta di direttiva del Parlamento europeo e del Consiglio relativa ai limiti della brevettabilità in relazione all'elaborazione automatizzata dei dati e ai suoi campi di applicazione: È previsto che il Parlamento Europeo sia chiamato a decidere sulla Direttiva sulla Brevettabilità del Software il 23 Settembre. La direttiva, come proposta dalla Commissione Europea, demolisce la struttura base della legge attualmente in vigore (Art. 52 della Convenzione Europea sui Brevetti) e la sostituisce con uno Standard Trilatrale sviluppato nel 2000 dagli uffici brevetti USA, Europeo e Giapponese, in accordo con il quale tutte le soluzioni a problemi "implementate al computer" sono invenzioni brevettabili.
